Welcome to buddi. These Terms of Use ("Terms") constitute a legally binding agreement between you and Buddi governing your access to and use of the Buddi website, platform, and services (collectively, the "Service").
BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree to these Terms, you may not access or use the Service.
1.1 Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:

buddi is a wellbeing support and adherence platform that:
- Connects individuals with healthcare practitioners
- Provides daily reminders and support for health goals
- Tracks progress toward wellbeing objectives
- Facilitates communication between patients and practitioners
- Offers structured plans for various health and wellbeing areas
2.2 What Buddi Is NOT
IMPORTANT
Buddi is NOT:
- A medical service or healthcare provider
- A replacement for professional medical advice, diagnosis, or treatment
- An emergency response service
- A crisis intervention service
- A substitute for in-person healthcare consultations
- A medical device
3. MEDICAL DISCLAIMER AND LIMITATIONS

- Buddi is a support tool designed to help users adhere to plans established by qualified healthcare professionals
- All content on the Service is for informational and adherence support purposes only
- No content on the Service should be considered as medical advice or a substitute for professional medical consultation
- The Service does not create a doctor-patient or practitioner-patient relationship
3.2 Consult Healthcare Professionals
YOU MUST:

- Never disregard professional medical advice or delay seeking it because of information received through the Service
- Consult your healthcare practitioner before starting, stopping, or changing any treatment, medication, or health program

4. User Accounts and Registration
To access certain features of the Service, you may need to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your login credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
5. User Conduct and Acceptable Use
5.1 Prohibited Activities
YOU MAY NOT:
- Use the Service for any illegal purpose or in violation of any laws
- Violate, infringe, or misappropriate the rights of others
- Impersonate any person or entity
- Provide false or misleading information
- Harass, abuse, threaten, or intimidate others
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Use automated systems to access the Service

6. Healthcare Practitioner-Specific Terms
Professional Responsibility
If you are a healthcare practitioner using the Service, you acknowledge and agree that:
- You must maintain all required professional licenses, certifications, and credentials
- You remain subject to all professional codes of conduct and regulations
- You are solely responsible for all clinical decisions and care provided
- Buddi is a support tool and does not replace your professional judgment
- The practitioner-patient relationship is between you and your patient, not with Buddi
- You must comply with AHPRA regulations and professional obligations (Australia)
7. Patient/Individual User-Specific Terms
7.1 Your Health Responsibility
If you are using Buddi as a patient or individual:
- You are responsible for your own health and wellbeing
- You must continue to see your healthcare practitioners regularly
- You must follow the medical advice and treatment plans of your practitioners
- You must be honest about your health status and progress
- You must not use Buddi as a replacement for professional medical care
7.2 Self-Harm and Crisis Situations

8. Content and Intellectual Property
All content and materials on the Service, including text, graphics, logos, software, and trademarks, are owned by or licensed to Buddi and are protected by intellectual property laws.
License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.
9. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
Health Information: The Service may involve collection and use of health information, which is considered sensitive personal information under Australian law. By using the Service, you consent to collection and use of your health information as described in our Privacy Policy.
10. Disclaimers and Limitations of Liability

10.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or health complications arising from your use of the Service.
10.4 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer rights or guarantees that cannot be lawfully excluded under the Australian Consumer Law.
12. Payment Terms (When Applicable)
These terms will apply when Buddi launches paid subscriptions or services.
Subscription Fees
- Fees are displayed on our website and in the Service
- All fees are in Australian Dollars (AUD)
- Subscriptions are billed in advance on a recurring basis
- Subscription fees are generally non-refundable except as required by Australian Consumer Law
13. Termination
Termination by You

Termination by Us
We may suspend or terminate your account immediately if you violate these Terms, provide false information, or engage in prohibited activities.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia.
Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Western Australia.
15. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Buddi regarding the Service.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or website notification. Your continued use after changes constitutes acceptance.
